California’s anti-price gouging statute, Penal Code Section 396, prohibits landlords and other businesses from raising rent (or the price of many consumer goods and services) by more than 10 percent after a state of emergency has been declared by the President, the Governor, or local officials. Rent increases are limited to 10% for the duration of the emergency, irrespective of the duration and whether the unit becomes vacant.
